TrialSmart Update

The TrialSmart update is coming along nicely. I just about have it completed. I removed many windows and integrated them into the interface. I’ve also added the Clarity Legal Synch service into the application itself so that will help users take more advantage of the synching service and the low prices Clarity Legal charges.

TrialSmart Update to be Released May 27th

I feel confident that I will be able to release the update to TrialSmart on May 27th. This will be the yearly update to the software and will be a total overhaul of the software with an improved interface. DepoSmart was released 2 weeks ago and the reviews have been unanimous, users love it.

I’m almost positive that it is never the software that helps people do well in legal proceedings but the people behind the software. As much as software developers think they have the best and easiest software to use, it really is the users that make the difference, not the software.

DepoSmart Upgrade Released

I released the biggest upgrade to DepoSmart since it was initially released back in 2006. The app has been totally revamped. There used to be over 45 windows in the application, I have now reduced those in half. The app is more iTunes like and it’s is easier to do just about all functions in the app versus the prior version.

TrialSmart will be out next week, probably end of the week, then a quick release DocSmart and then a few surprises after that.

Here is a list of a few features in no specific order:
1. Easy to install, just drag the application to the applications folder from the installer.
2. Set Margin preferences for Margin Left when printing.
3. Set Margin preferences for Margin Right when printing.
4. Set Margin preferences for Margin Top when printing.

74. Add or Associate video files to a transcript.
75. Replace, Delete, and play all video files associated with a transcript.
76. Play, Delete, and Extract all video clips created for a transcript.
77. Create convenient video clip reports including deponent name, clip range, clip duration, and clip text.

79. Create detailed Annotation reports on a single transcript or all transcripts and one, all or, individual issues.
80. Send off synch jobs or video to text to synchronization jobs to Clarity Legal.

As always, the application works on Mac, Windows, or Linux. Clarity Legal is the only company in the world that has such application strength. This means that you can share files/databases with other DepoSmart users easily regardless of operating system.

DepoSmart to be Updated Today

On Monday I will release an update for DepoSmart. This is the biggest update since the app was initially released in 2006. This is the second app update so far this year, the Clarity Viewer was the first large update. The TrialSmart and DocSmart updates are just about done and I will have a release dates for those updates sometime next week. I know everyone is inquiring about the TrialSmart update, so I will get a firm date sometime next week.

DepoSmart will work on Windows, Mac, and Linux – as usual, and there is a Clarity SQL Server application which allows users to concurrently share the same DepoSmart database at the same time. So, you can take any existing desktop/local database and load it up to the Clarity SQL Server and it can then allow everyone with a desktop license to annotate, run reports, issue code, etc. at the same time with other users.

The changes to the app have been substantial.

Apple cashes in but Google takes App Download Lead

An internet analyst, Canalys, on Monday issued a report on app downloads at four major mobile stores: Google (GOOG) Play, Apple’s (AAPL) App Store, Microsoft (MSFT) Windows Phone Store and Research in Motion’s (BBRY) BlackBerry World.

Apple and Google dominated the downloads and revenue was up 9% with emerging markets showing the strongest growth. This was the first month that Google beat Apple in the download market. I anticipate that Google Play will distance itself in the download market because emerging markets are going to being use cheaper Android phones vs. Apple’s more expensive iPhone.

Apple’s App store accounted for the largest share of revenue among the four stores, around 74%.

Google saw the greatest number of downloads — about 51% — with Apple close behind.

“Apple’s App Store and Google Play remain the heavyweights in the app store world,” said Canalys’ Tim Shepherd. “In comparison, BlackBerry World and the Windows Phone Store remain distant challengers today, though they still should not be ignored.”

New DepoSmart Version coming this week!

I feel pretty sure that I can get an update to DepoSmart out this week. This update will be a major upgrade to the application, and will be the biggest change to the application since it was released in 2007. I will report more details by mid-week but the applications is much easier to use and several windows have been combined into the interface.

Clarity Viewer Update – 1.4.8 – Released

This morning I added the ability to update a Clarity Legal Viewer transcript. A user can now set the transcript properties for the following transcript fields:

First Name
Last Name
Middle Initial
Title
Volume
Date
Start Page
Type of Transcript (Expert, Fact, Other)
Final (Yes or No)
QC’d (Yes or No)
Other (Another name for the transcript)
Reporter: Add the taking reporter

Exactly how ginormous is Android?

I read a very informative article on Android’s growing market share. There is no denying that Android, Google’s operating system for mobile devices, is big. For example, Android is the OS on 42% of all consumer compute devices.

We have scoured the web for data that will help us show exactly how big Android is in the smartphone world. And in every way we looked at it, Android is ginormous.

Here’s the data that shows current smart phone web traffic, Apple vs Android market shares in the top 5 Android and iOS markets, how Android outpaces growing smartphone market, numbers showing Android is the largest smartphone manufacturer, and Android trends and growth patterns. It’s amazing to see the growth of the Android market.

I’ve never cared for the name though.

DocSmart v.1.3.20 Update

DocSmart, Clarity Legal’s production management system for the Mac OS X environment will be getting an update tomorrow. DocSmart is a feature rich application for those users that want to completely manage the discovery and production of documents during the life of a case. DocSmart is specifically designed for law firms that want to manage production and document review! DocSmart is also a cost-efficient way to manage and review scanned paper or electronic documents for cases of all sizes from 100 pages to millions of pages.

If you’ve used Summation or Concordance, then you’ll love DocSmart because you can use Summation and Concordance load files and import them into DocSmart. The app was written for sophisticated document review on the Mac Desktop but the application works on Windows and Linux as well.

As with any new software, which DocSmart is (less than 1.5 years old) there were certain features that needed to be changes and optimized. During the better part of a year, I have been routinely updating the application to simply certain features, add new features, and make the app more powerful in certain areas. The most important additions come in database speed, image loading, and OCR management as well as improvements to tagging and tag querying.

Here is a complete list of all features in the new version of DocSmart for the Desktop:

1. Create new cases in seconds
2. Desktop-single user licenses available as well as client/server licenses available for the same price
3. Easily add columns to your database
4. Set database types for newly added columns to be either small text( 400 characters or under), date, integer, or text (ideal for large text fields such as OCR data).
5. Set length of all small text fields to your preference.
6. Delete columns from your current database.
7. Rename columns in your current database.

9. Index specific text fields to increase searching speed. Indexing database fields creates a word index as well so you can see specific words and the occurrences of each word.
10. Attach field lists or coding fields to specific database fields. This helps in standardizing coding of your database.
11. Use the column list window to sort and view specific columns in your column view.
12. Choose to select all columns in the column list to view or only one field (Doc_Id).
13. Convenient toolbar icons for getting to specific functions in the database.

Another Win for a Great Client

We get several of these a month (3rd one this month) and occasionally I post them, this one is from a long time client, Kern Lewis. Kern was one of my first clients back in 2005, when I introduced TrialSmart on Mac OS 9 (long time ago). I was living in Dallas at the time and Clarity Legal was just a startup. I had just left Thompson and Knight where I worked for 8 years as Litigation Support Director and Trial Support Coordinator. Since Kern was so close to Dallas, I drove to Grapevine and trained him for an afternoon. Mostly we talked shop, trial methods, and how he did trials. I was instantly impressed with his office and his firm’s total support of Macs. Everyone had everything Mac. We laughed that between us we’d been in trial over 150 times. Basically, you couldn’t BS Kern. He knew how to go to trial so we instantly hit it off.

Kern is what I consider a specialist at trial work. Most trial lawyers are one in name only but Kern Lewis is actually hired to just go to trial. That is his practice. He gets called 3-4 weeks before a trial and takes over from the previous trial team. His firm is Lewis-Foreman-Daphinot.

About 3 weeks ago I received an email from Kern, he’d just updated TrialSmart and was ready for trial and had a few questions about moving databases from one system to another. Then a few days later he had some questions about a problem pdf that was not saving. I showed him how to handle the pesky pdf outside of TrialSmart since it was a Preview issue (not all pdfs are created equally). A few days later I received this email from him in the subject header:

“John – THIS IS SO FREAKING AWESOME!”

As Kern was in trial I got another email from him, he was having issues with using dual monitors at trial and couldn’t figure out why the OS was not recognizing the second monitor. I showed him a few tricks to get it to work (you need the second monitor on the right in your system preferences). Then I didn’t hear from him for 2 weeks, then I got this email this morning:

Just wanted to say thanks again for your help during my three week trial. TrialSmart worked wonderfully and as usual, my only complaint is that I wasnt using the program for weeks before trial, to be more organized than I was. It was a wonderful feeling for me to be able to make an equal to or better trial presentation than the opposition consisting of three lawyers and a technology guy!

Happy to report I got a 5.1 million dollar verdict in my trucking accident – mild traumatic brain injury case.

Lots of times as developers we like to tout our software, but really the software is a small fraction of what goes into a win – I can’t take much credit and I never do. The credit needs to go to the trial team, their staff, and their client’s faith and trust in them to take risks and present a great case to a jury.

Clarity Viewer Web Near Completion

To coincide with the latest release of the updated Clarity Viewer for Mac, Windows, and Linux on the desktop, I am just about finished with the code for the web version. The web version is very simple and elegant.

Basically, using any WebKit enabled browser, you’ll be able to head to the Clarity Legal website using your browser and click on a drop-down menu on the main screen. Then enter your email address and the website will create a database for you to store your transcripts (you’ll never see any of this). Then you’ll be presented with a screen for loading CLT transcripts to your database. Once loaded you can then click on a transcript to view it in your browser. All the typical needs are there just like in the desktop version:

Clarity Viewer Web Features:
1. You can store an unlimited number of CLT transcripts in the web version.

2. You can highlight segments of a transcript and save the highlight in yellow.

3. You can add note segments to a transcript which are saved in blue.

4. Under each transcript there are now 3 sub-actions – Highlights, Notes, and Index.

5. You can view a transcript’s word index. For each transcript a list of words is listed and the count is provided. Toggle on the word, and the hits for each word will appear, click on it and go directly to the transcript location.

6. Share transcripts, highlights, and notes with other DepoSmart users by exporting to a CLT file that contains the transcripts, your notes and highlights included.

7. Plus and Minus button at bottom left of screen allow user to add and remove transcripts from the transcript list.

8. Left and Right buttons at the bottom center of the viewer screen allow users to toggle up and down index word hits in a transcript.

9. Use the page search field to go to a specific page in a transcript.

10. Print single page transcripts from CLT transcripts.

Clarity Viewer – v1.4.7 – Released

I’m happy to announce the release of the FREE Clarity Legal Viewer version 1.4.7 for Mac, Windows, and Linux.

The viewer allows users to view CLT or Clarity Legal Transcripts which can be used on 3 different platforms, as well as the web version to be released in less than 2 weeks. CLT files are the only transcript you can use on any system. The Clarity Legal Viewer web version will have 95% of the features you see below except you can’t print a transcript, only download it to pdf which many prefer anyway. So, basically you can view the transcript now on any frickin’ system you want, another first for the industry.

The new viewer has these features (some new and some come from the prior version):
1. You can now store an unlimited number of CLT transcripts in the viewer application. In the past you could only view 1 transcript at a time which was done by loading the app into the program. Now there is a list of transcripts to the left of the Main Viewer window that allows you to view transcripts you have loaded.

Production Format Requirements

I recently gave a speech at the Tennessee Bar Association about how to better manage documents for trial and depositions and I focused on several areas. One of those areas was the image file requirements one should request and send from and to opposing counsel.

I received a couple of emails last week from a customer who was using a trial presentation app on the iPad and had it lock up twice during a hearing. It was strange they were coming to me to ask for help (the developer has no phone number to call). When I inquired what was the DPI of the images, the user said most of the images were 300 DPI. So, after searching some blogs I discovered that this iPad in particular loses memory when displaying images over 150 dpi. The iPads simply don’t have enough memory to display larger images than 8×11, and the developer isn’t doing some coding magic to get around this problem.

This is an issue in my opinion, because the industry HAS specific specs most commercial cases follow. Here are the image specs one should request during a commercial production:

Image Requirements
1. Minimum image resolutions of 200 DPI for black and white images, 300 DPI is preferred for use at trial. You’ll see the difference when blowing up exhibits at trial.

2. All images should be named for the beginning bates number;

3. Single-page Group IV TIFF files. This is the required format for black and white images;

4. Single page JPG files. This is the preferred format for color images. JPG files will not be accepted for black and white images; No color TIFF images will be accepted for color images;

5. Bates numbers shall be branded to the images so that the numbers print; and

6. Each image shall have branded on it any applicable confidentiality language pursuant to the parties’ protective order;

7. If PDF files are used as a last resort, please use single page pdf files in black and white. All color PDF files should be converted to JPG format and specs set above.

Using specifications like the ones above will only help standardize your productions and reviews and reduce time spent reviewing docs and reduce cost associated with reviews.

Facebook Admits that Business Model is Losing Customers

Facebook has made the startling admission that teenagers are becoming bored with the social networking giant. Facing competition from younger, more agile and ‘cooler’ apps such as Snapchat and Instagram, Facebook fears its long-term business could be harmed.

And as Facebook approaches its tenth anniversary the firm published its annual 10-K report last month revealing that its younger users are increasingly turning away from the multi-billion dollar business.

Published last month, the annual company report states, ‘We believe that some of our users, particularly our younger users, are aware of and actively engaging with other products and services similar to, or as a substitute for, Facebook.

I’ve never cared for Facebook at all and I barely use Twitter but I was surprised to read this article and hear Facebook be so candid about it’s business model and future.
